Rahul Gandhi, a former MP and leader of the Congress, filed a review petition with the Gujarat High Court asking for a stay of execution in a criminal defamation action stemming from his comment that “Modi Thieves”; nevertheless, the petition was denied.

Due to this setback, he may be sentenced to jail time and forfeit his parliamentary position while contesting the guilty judgment.

K. C. Venugopal, general secretary of the AICC, commented on the news by saying, “We will move against the Gujarat HC order dismissing Rahul Gandhi’s plea to stay his conviction in the defamation case.”

According to LiveLaw, Justice Hemant Prachchhak heard the argument, and on May 2, the court reserved its decision. Gandhi’s review request, however, has already been denied by the court.

Rahul Gandhi said anything during the 2019 Lok Sabha campaign that prompted the initiation of a criminal defamation action against him.

He said, “Why do all thieves have the same surname?” while referring to those with the same last name as him, such as Lalit Modi and Nirav Modi. The criminal defamation case’s central argument was based on this statement.

Purnesh Modi, a former minister and member of the BJP, accused Rahul Gandhi of defaming the whole Modi community in a criminal defamation lawsuit. Gandhi, on the other hand, has stated that he did not make the disputed comment with the intention of doing harm.

Rahul Gandhi was found guilty of defamation in March after his case was reopened earlier this year after nearly two years of legal stalemate.

His sentence was deferred, though, and he was given bail the same day. This gave him 30 days to appeal his conviction.

Rahul Gandhi went to the Surat Sessions Court on April 3 to contest his conviction and ask for a stay of the sentence, but on April 20, his motion was denied. Nevertheless, on April 3, the Surat Sessions Court granted him bail, which would be valid until the outcome of his appeal.

Gandhi’s “status as a parliamentarian,” which exacerbated the significance of his words owing to their public character, led the judge to impose the maximum punishment of a two-year prison term.
